These terms apply to all website design, branding, and digital marketing services offered by Motion Marketing.
1. About us
These Terms & Conditions ("Terms") govern the agreement between Motion Marketing ("we", "us", "our") and you ("Client", "you") when you purchase or commission our services.

2. Services
We provide custom website design and development, branding, and related digital marketing services as described on our website and in project proposals or package descriptions. Services may include one-pagers, portfolio sites, business websites, webshops, logo design, and brand identity packages.
The exact scope, deliverables, timeline, and price for your project are defined by the package you select on our website or in a written quote we send you.
3. Agreement & acceptance
An agreement is formed when you (a) complete an online payment via our checkout, (b) accept a written quote by email, or (c) confirm a project in writing. By placing an order you confirm that you have read and agree to these Terms and our Privacy Policy.
You must be at least 18 years old and authorised to enter into a binding agreement on behalf of yourself or the business you represent.
4. Prices & payment
All prices on our website are listed in euros (€) and, unless stated otherwise, are exclusive of VAT (BTW). Applicable VAT will be added to your invoice in accordance with Dutch tax law once we are VAT-registered.
Payment is due in full at the time of order unless otherwise agreed in writing. We accept payment via Stripe, including iDEAL and credit/debit cards. Payment processing is handled securely by Stripe; we do not store your full card details.
Work on your project begins after we have received your payment and any required project information from you.
5. Delivery & timelines
Estimated delivery times (e.g. "~1 week", "~2 weeks") are indicative and start once we have received payment and all necessary content, assets, and feedback from you. Delays caused by late client input, scope changes, or circumstances outside our control may extend the timeline.
We will deliver your website or design files in the agreed format (typically a live URL, source files, or handover documentation). You are responsible for providing domain access, hosting credentials, or third-party accounts where required.
6. Revisions
Each package includes a set number of revision rounds as listed on our pricing page. A "revision round" means one consolidated batch of feedback from you, not individual messages. Additional revisions beyond the included amount may be billed at our then-current hourly or fixed rate, agreed with you in advance.
Requests that fall outside the original agreed scope (new pages, new features, redesigns) are treated as change requests and may require a separate quote.
7. Your responsibilities
You agree to:
- Provide accurate project information, text, images, and brand assets in a timely manner
- Ensure you have the rights to use any content you supply
- Review deliverables and provide feedback within a reasonable timeframe
- Maintain backups of your own content where applicable
- Pay any third-party costs (domain, hosting, plugins, stock assets) unless included in your package
8. Intellectual property
Upon receipt of full payment, you receive the rights to use the final delivered design and website for your business purposes. We retain the right to showcase completed work in our portfolio and marketing materials unless you request otherwise in writing before delivery.
We may use third-party tools, fonts, libraries, and frameworks subject to their respective licences. Open-source and licensed components remain governed by those licences.
Until full payment is received, all work product remains our property.
9. Warranty & support
We warrant that services will be performed with reasonable skill and care. We will fix bugs or errors in our delivered work that are reported within 14 days of delivery, provided they relate to the agreed scope and were not caused by client modifications or third-party changes.
Ongoing maintenance is available via our Site Care plan (€150/month) covering updates, content tweaks, small fixes and support. Hosting, domain registration and major redesigns remain separate unless agreed in writing.
10. Cancellation & refunds
Free concept: Concept homepage designs offered before purchase are free and create no obligation. If you do not proceed, you owe nothing.
Money-back guarantee (website packages): Website packages are built to increase trust, compliments, and revenue for your business. If, within 30 days of final delivery and after you have supplied the agreed content and feedback, the delivered site clearly fails that promise and we cannot reasonably remedy it, you may request a full refund of the package fee. This does not cover issues caused by your own content, third-party tools, hosting, or changes made by others after handover.
Outside the guarantee, because our work is custom-made, sales are otherwise final once work has started. If you cancel before we have begun work, you may request a refund minus any non-recoverable costs. If we are unable to deliver the agreed service due to our fault, we will offer a full refund or alternative solution.
Site Care (€150/month): Monthly maintenance can be cancelled anytime before the next billing cycle. Fees already billed for a started month are non-refundable unless we fail to provide the agreed care.
Statutory consumer rights under Dutch and EU law remain unaffected where applicable.
11. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the amount you paid for the specific project in question. We are not liable for indirect, consequential, or lost-profit damages, including loss of revenue, data, or business opportunities.
We are not responsible for downtime, security issues, or performance of third-party hosting, domain registrars, payment providers, or plugins after handover.
12. Force majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control, including internet outages, supplier failures, illness, or government measures.
13. Governing law & disputes
These Terms are governed by the laws of the Netherlands. Any dispute will first be submitted to good-faith negotiation. If unresolved, disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law requires otherwise.
14. Changes
We may update these Terms from time to time. The version published on our website at the time of your order applies to that order. Material changes will be reflected in the "Last updated" date above.
